Increasing restrictions to the principle of private autonomy has caused a deep doctrinal debate. Doctrinaire opinions, restrictive autonomy rules and the case-law are discussed to account to this problem in order to determine how the level of autonomy has changed during the period 1983 - 2011. This subject is first presented from a theoretical point of view. Then sentences dictated under the period of study by the Supreme Court and in general by the Civil and Commercial Chamber of Appeals and the Contentious-Administrative Federal Courts, are analyzed by a random sampling from all of them found in the Supreme Court and commercial publishers databases. The fundamental hypothesis is that the increasing restrictions on the autonomy of contract are determined by economic factors. Sentences reveal and relevant bibliography are annexed in information matrices.
