Assuming that the Law is not the only regulator of human behavior but that it coexists with other mechanisms which regulate human activities in different ways, the main issue addressed in this thesis is the study of the ‘Code’, understood as the set of rules and instructions which determine how the hardware and software that constitute electronic devices and computer systems and networks which characterize modern societies are configured. This paper deals with the classic tension between freedom and control in the context of technological societies, but it is analyzed specifically in the light of certain particular problems posed to the Law by the emergence of that powerful - and silent- regulator of human behavior: the Code. The conclusion drawn is that it is necessary to create a new legal principle—namely, the principle of self-determination and protection of individual freedoms in digital environments—in order to guard the individual in the societies of science and technology. From this new principle, rights would emerge ensuring participation, granting the power to obtain information on the technological architecture and, after learning the technical rules of digital environments, allowing the individual to control its design and even refuse to use those computer systems that affect individual rights and freedoms. In sum, new legal tools are proposed aiming at increasing the participation of individuals in the "construction" of digital environments.
